Waltham Forest Local Plan - Comments by the 14th December 2020


The Local Plan will be used to direct developers to certain sites listed in Part 2 of the plan. 

Part 1 is the policies which will control the developments they can undertake. 

If the Government's Planning White Paper is approved by Parliament then a developer will be able to come and develop on one of these sites, assuming they comply with the policies, the council will be powerless to stop them. It is vital the policies are written in such a way as not to be ambiguous!

The Planning Application 201548 for the demolition of the Nurse's Home was approved in July and work starts soon. Bart's have decided this is the best site for the new hospital.

I was asked to put together a presentation about the Planning Process. It was a useful exercise as it made me realise why our Planning Committee nearly always approve applications. They have a legal duty "of a presumption in favour of sustainable development". That means they have to approve an application so long as it complies with all the policies of Waltham Forest and the GLA's London Plan and the Government National Planning Policy Framework. That means residents have very little say and horrendous developments come forward!

Closing Date for Objections 17th October and scheduled for Planning Committee for December or January. One of the fastest planning applications ever. Homebase sold the site to Inland Homes in January 2020 for £28m. By July all the consultants report prepared and Public Consultation carried out and Planning Application submitted in September. At no point has the scheme, developed by the architects earlier in the year, been changed by public comment and reaction. Once again the planning system has failed residents.

Hello everyone


Just attended the One London zoom meeting.

  1. Several campaign groups are considering Judicial Reviews against the LTN Covid road closures. It is recommended that anyone who does so does it under the Arhus convention which restricts the costs you might be liable for. 
  2. Lots are writing letters to Grant Shapps and others. 
  3. There is a petition to get the issue of road closures debated in Parliament .... a sub-group are working on the wording now. Will let you all know as soon as it is published so you can all sign.
  4. The proposed London wide demo is not going ahead just now because of the Covid situation
  5. Freedom of Information requests. All the campaign groups are putting in FOIs in their local areas particularly about emergency services. It is recommended that anyone putting in an FOI uses the "what do they know" website as this will record all the requests for the public to view and allow sharing and tracking. https://www.whatdotheyknow.com
  6. Mayor's question time is on November 12th
    Only Assembly Members can put questions to the Mayor at Mayor's Question Time, but you can suggest a question to be asked by emailing suggestaquestion@london.gov.uk.

    We should send questions via our Assembly Member Jennette Arnold. If you remember Jennette presented our original 6,000 plus petition in the Assembly for us.


The WFS4A committee is still not meeting in person due to ongoing Covid restrictions and concerns. However we are still working!!

We still need your help in getting in more objections to the Hilltop road closures. You will remember that Stay Together tried to get lots of objections in to their road closures in Leyton. Now we are trying to get more objections than votes in favour. Brief description of the Planning Process

In very simple terms the Government sets Planning Policy ( a review is currently underway which will make the Local Plan even more important) by laying down National Policies and Regional Housing Targets. In London’s Case the GLA and Mayor create the London Plan (currently under review) and sets Policies and Targets for the 32 London Boroughs (the City does it’s own thing!).

Waltham Forest is reviewing its Local Plan and is trying to work out how to achieve the target of 27,000 new homes by 2035. It has already consulted on possible sites and decided to separate out these, so the Local Plan is in two parts. Part 1 is the Polices and this will be published in a week or so, but the list of possible sites has already been published and this is what is being consulted on at the moment.

  1. You said you would be submitting an application to the Planning Dept for demolishing the existing building in November. Can that be delayed until it is clear the site can be developed i.e. a planning application has been submitted?

An application for the demolition of the building has been submitted to the Local Planning Authority. The project team will be working closely with planning colleagues to ensure that a well-designed Families and Homes Hub can be delivered. Demolishing the existing structure in this timeframe allows us to more easily ‘de-risk’ the site from hidden hazards that aren’t typically revealed until after demolition, which might otherwise cause delays. It also helps mitigate the risk of antisocial behaviour that can present with an empty building, such as squatting or vandalism. The Council will be following the correct due process with the demolition.

 

  1. From the information you gave it appears the new building will be 9 storeys high which means it will tower over the adjacent Woodside Academy. Will there be no windows on that side of the building to ensure there is no overlooking of the 900 children in the school? It is very important to all of us that the safety and wellbeing of children, parents and teachers is prioritised and ensured at all times. Any overlooking of the school is a planning consideration and as part of the planning process, we will be required to show that the school is not overlooked. We are in the early stages of the design process and therefore the detailed design of the building, including position of windows, has not yet been developed. As the design develops, we can share more information on this and ask for feedback and comment.

 

  1. Normally a construction logistics plan is submitted with a planning application or is part of the information that has to be submitted once the plan is approved. In this case that won't be acceptable as the only access to this very tight site adjacent to Foundery Mews and Woodside is via Forest Road or Wood Street. 

That’s correct, a construction logistics plan will be submitted as part of the planning application. We will ensure we discuss the construction logistics plan with you prior to the planning submission and happy to meet with you to run through this at the appropriate time.

 

  1. Is it proposed to close off Wood Street to create space for the portacabins and the heavy lorries delivering and collecting from the site? We are already suffering problems from heavy vehicles that are accessing the Hylands site just up the road. When 1 Hoe Street was rebuilt Howard Road was closed. At Blackhorse Station one lane has been out of use for months creating massive tailbacks. If Wood Street is not closed (and bear in mind the bridge by the station has a low clearance level) the only alternative is to take out a lane in Forest Road. That is by the junction where many children cross to get to Bremer School and Woodside so very expensive traffic and pedestrian management will be needed. This will go on for 2 years!

The construction management plan will include traffic management measures to minimise disruption to the surrounding road network. The safety and wellbeing of children, parents and teachers of the nearby schools is important to us and will be prioritised.

 

  1. Noise - buildings sites inevitably create noise and the Juniper House site can be heard up in Walthamstow Village and Hylands can be heard in adjacent streets. How are you going to ensure the children's education at Woodside is not disrupted as they will be adjacent to the noise, dust and pollution? 

Ensuring that disruption to the school is minimised as much as possible is a key priority for us. Proposals for managing noise, dust and air quality will form a key part of the contractor’s health and safety proposals. We have already met with the school to discuss the redevelopment proposals and how we can ensure we minimise the impact of the construction on the school. We will ensure lines of communication with the school are open at all stages of the development.

 

  1. As you are aware the Homebase site (4.5 years construction period)  will start  to be cleared next year which will coincide with your plans for completion by 2023. That means 2 large building sites virtually adjacent to each other. This also means more construction traffic clashing with students attending WF College, Bremer, Woodside and Holy Family not far away. How do you plan to deal with this while allowing the community to carry on their daily lives?

The Council will work closely with the developer of the Homebase site to ensure that construction management plans are coordinated to minimise disruption to the local community.

The Mall - Town Centre Update 1

Looking through the Planning Application for the Mall it becomes clear the scheme is designed for the benefit of those paying rent for the 538 flats in a 34 and 26 storey block alongside Selborne Road opposite the car wash. They will have a roof top Winter Gardens and other gardens coming to 2,593 sqm with a lounge with wonderful views. 

Meanwhile the larger number of Town Centre users will loose 5,437sqm of open space so the shopping centre can be extended with an additional 43 flats. The 4,800sqm left for the community is split between a community facility inside the development 2,225sqm (haven't found the details of that yet!) and the open space which will be 2,575sqm.

It is good to know the architect had his/her priorities in the right place as under IMPORTANT VIEWS it states "Optimising height to create views over Walthamstow Wetlands to the west and London City to the south". Just to rub our noses in it they tested their ideas "to make sure they make a positive contribution to the existing and evolving townscape"!

C&R have not only refused, over the last 4 years, to engage properly with the community but have totally ignored them during the development of this new scheme. The Access and Design Statement says the community was consulted in October 2019 when they tried to fiddle the planning process using the Section 73 procedure. Having been stopped from doing that they decided to submit a whole new scheme, very similar to the old one, but with no community consultation. The Planning Officers and the GLA officers were consulted but not us!

The result is we are allowed to keep the avenue of lime trees, but the Town Square is now very pokey and from the pictures looks very crowded when only a handful of people are around!! Hardly Covid 19 friendly!

This is the magnificent roof garden with stunning views - not surprising as it is 20 storeys higher than the Travelodge. Or put it another way you could but Juniper House on top of the Travelodge and still have your stunning views!!

I don't fancy being near the top if fire breaks out - oh we seem to have forgotten Grenfell already!

In 2018 C&R were granted planning permission to build 4 towers on the Mall site rising to 29 storeys, and fell 80 trees, including most of the avenue of lime trees. In July 2019 the fire broke out and we are still waiting for the whole site to re-open. In October 2019 they said they were going to modify the scheme and reduce the tower blocks from 4 to 2 and move them away from the underground tube lines to reduce construction costs. They appointed new architects and tried fiddling it through the planning process by using a Section 73 process, but they quickly changed their mind and said a new planning application would be coming in early 2020.

Covid struck and retail changed dramatically so it made it even more important for C&R to find another way of keeping the company afloat. They did a deal with TfL to enable a second entrance to the tube station, and to move the tower blocks further down Selborne Road creating 2 separate blocks, one 34 storeys (5 more than the consented scheme) and the other of 27. This creates space for 495 flats with another 43 above the expanded shopping centre. Just 45 less than the Homebase site in Forest Road which is only 18 storeys!!

The avenue of lime trees have been saved but the Town Square is squeezed out and is split by the extension to the shopping centre and the 43 flats above. As they say a picture is worth a thousand words so take a look at the future...........
